Wal-mart workers in Weyburn have won the battle, but the company isn't backing down from the fight.

After years of wrestling with Wal-mart, the decision came down Monday by the Saskatchewan Labour Relations Board to grant union certification to the store's workers in Weyburn.

The decision comes nearly five years after the United Food & Commercial workers Local 1400 applied to the LRB to represent them.

Wal Mart had tried to squash the attempts of the workers by taking the case all the way to the Supreme Court on two different occasions.

Vice President of Corporate Affairs for Wal-mart Canada Andrew Pelletier is disappointed with the decision.

Pelletier says they expect to seek reconsideration of this decision to certify the store without a vote.

If I was Walmart I would close the store down and walk away. Yes it will lose profits but it needs to protect against the precedent.

The only way to get Wal-Mart to clean up their act and treat their employees fairly is to get a union in to fight on the employees' behalf. How fair is it that an employee who has worked for Wal-Mart for 10 years makes $1.10 less than newly hired associates? Their raises are a joke. They do not care about their workers. It is all a big facade.

To pay knuckleheads to sit and negotiate a contract and get you what the company would have already given you.....ever wonder why the people who work for UFCW in Winnipeg, went on strike a few years ago. People have choices and choices have consequences.

This is just another example of that premise. The fact is, Wal-Mart benchmarks sales and profitability at each of its store locations. If one falls too far below the acceptable threshold, they will make a business decision based on that data. If that means a location closes, so be it. Its not personal, its business reality.

Respecting Canada and our values.

Canadians treat each other with respect. Large American retailer Walmart has shown Canadians nothing but disrespect. Poor wages, low benefits and little support for Canadian manufacturers have added up to a poor deal for Canadian workers. When Canadians in Jonquiere Quebec and Gatineau Quebec legally joined a union, Walmart showed Canada contempt by just closing up the operations in these two locations.
What will happen in Weyburn? Will this retailer step on the Canadian flag by their actions of just playing a game with our fellow citizens? Time will tell.
Canada is bigger to Canadians than any Walmart store. If Walmart doesn't want to play fairly or buy our sovereign rules, then it is should pack its bags and leave so we can get a corporation that cares about our values.

Step on the Canadian Flag?

Step on the Canadian Flag? Is that the Union line now - not to represent its members but to defend Canada? The same unions who are attached at the hip to the NDP - the NDP which recently partnered with a separatist Party in the Canadian Parlaiment?! The union movement was needed in the 1930's, but having an NDP government in our province for 50 or the past 60 years has ensured that basically every Saskatchewan worker is unionized. Business owners have rights in Canada too my brothers - as do the people of Weyburn, Moose Jaw, and North Battleford - all cities this union will rob of its Wal-Mart. Will our brothers and sisters help us find new industry for our cities? Certainly not. The work only to collect their dues. So the once mighty union movement has been reduced to buying signatures, buying LRB members, denying truths and becoming the equivalent of southern baptist revival preachers - preaching the teachings of a long discredited manifesto. Yes my brothers, the Regina Manifesto is still the bible for these "leaders" (Mr. Calvert included). The kool-aid is too strong in the chalice. It is blind socialism without a social conscience. Wake from the sleep brothers and sisters, abstain from the kool-aid for one month and do some objective research. Start with Tommy - you'll learn some very discomforting positions. Saskatchewan has only one explaination for population decline, nursing shortages, infrastructure deficits, lack of large industry, health care disfunction and so much more. It becomes an awakening.

Walmart is a disgusting example of corporate greed. I truly thought Canadians had more respect for each other. I see that U.S. attitudes are beginning to take hold; sorry to see that. Unions serve as a balance against the overbearing corporate whores that are running society. I am speaking as a small business owner who pays his help well above the Corporations. Having strong unions helps to level the playing field. Good luck to the workers involved. Oh, and to the person who talks about the $10.00/hour job... Have you tried living on that yourself?

Unions are not a joke!
Reputable and successful Unions take not only the needs of the employees into account but that of the employer. The future and protection of employees is serious business to Unions. Not true of big corporations and greedy CEOs.

Time and time again it has been seen and proven the devastation these big corporations and CEOs have caused directly to their employees AND indirectly to the public! Too many CEOs are greedy and narcissistic. They have had no one, no entity higher than thou to answer to...this is NOT true of Unions.

Unions answer to the Department of Labor and there are very very strict guidelines Unions must follow and adhere. An example is what an employee perseves as "wrongful termination" by their employer. Yes, the Union would step in and file mediation to resolve the matter. If the employee was truly terminated without right cause, but based on age, race and so forth the outcome is obvious, the employees gets his job back. but this scenario is true in the un-unionized sector of business. An employee has a right to sue their employer if they feel they were terminated improperly. In the same token, if the employer can prove the termination was warranted, via reports of incompentency, frequent tardiness, etc. the employer will have a positive outcome, whether it's mediation (union employee) or civil court for the un-unionized company. The Union has rules and procedures to follow as set down by Department of Labor. There are consequences for the Unions if they do not abide, much more so than these big corporate employers.

If these CEOS who stole your money, bought jets, lavish vacations and more had been under the scrutiny of an entity like the Department of Labor I believe that the state of our economy who have been a bit different.

I know first hand that a reputable Union makes quality and competitive benefits available. There are many employers who believe that a happy and valued employee will in turn make their business a success in their industry. A Union's job is to make sure the employer understands the needs of the employees. Again, the Union also provides benefit options, whether medical dental retirement that would otherwise be costly, not only to the employee but the employer if not obtained under Union representation. Why do you think insurance companies are so rich? If a Union goes under their reserve money, which there is a minimal that must be retained, maintained and audited by the Department of Labor in order to pay out any and all claims even AFTER the Union goes under!!! They don't bail out and leave the employees and medical parties high and dry not paying them what is rightfully theirs! NOT TRUE of these big corporations! When truly necessary Unions do not only fight for employees rights against greedy employers, but doctors and hospitals too!

Unions help keep businesses in AMERICA. Not to mention they are not "blue collar" anymore, there are plenty of "white collar" riding under the Union flag...

Get with the times...and know not all men stand alike (nor do all Unions). Knowledge is Power, Wisdom is Powerful.

It's simple, really

The contempt for organized labour posted by others in this discussion is, frankly, surprising. Generally, these views are perpetuated by a lack of understanding about the economic history and reality of Canada. Was it not for workers organizing to demand rights, we'd still be living in shantytowns working 60-hour weeks for subsistence wages. Obviously the issues have changed since the post-war period, but the fundamental balance of power in society has been shifting more and more in favour of capital (employers) and away from workers since the 1970s. Unions are very, very important today. Not only do they act as the collective voice of workers in bargaining the terms and conditions of work with the employer, but they protect workers from discrimination and harassment, push governments to pass legislation that protects all workers, pressure the employer to take health & safety seriously, and many other benefits that can only be achieved through collective action. Within the context of capitalist social relations of production, there is no way for workers to have power over their working lives without a union.

Our world has changed alot ovet the last few centuries and a not only does Western Canada run with very few unions it is has been a highly productive, wealthy area which forunately has delivered enough wealth to the feds to bail out the OVERPAID AUTO SECTOR UNION which can no longer stay competetive in todays world. Please do not give me your union sell, by the way I think the Auto Union bailout is a real eyeopener for everyone now that it has been brought to attention! This sqweeky mismanaged union needs a lot of lube to keep the tires rolling now at a cost to everybody within Canada!!

the store in weyburn

the store in weyburn becoming unionized is an absolute joke. all the media are reporting that the majority of the workers at the store have "voted" for a union. this is untrue. most of the people that voted for this union 4 years ago are not even working at the store anymore. the truth be known is that the majority of the workers presently at the store did not vote for the union and do not want a union beacuse they know that voting in a union could result in a store closure. all this union will do for the "workers" of the weyburn walmart is get their store possibly closed (but they will still want their union dues) and result in 104 people without jobs. a non union walmart job is better than no job at all. the wholesale club store in weyburn only pays less than a dollar an hour more for starting workers and it takes a long time to get into higher pay scales and it is unionized. fat lot of good the union did for those employees. the jobs at walmart are more stable than at the wholesale club in weyburn. the employees are happier at walmart also. they should ship all the union yahoos to siberia so they can fight for the rights of the bears. if this store closes it will a loss for weyburn and it trading area for sure. everyone will start going to regina and estevan again like they did before the walmart store opened here.

Hi Ken...
I wasn't going to respond, but you have some misinformation, so I decided to....

They actually didn't vote at all - in 2005, when the application for certification was put in, the law didn't require a vote. (It is now) If the company hadn't tied up the court proceeding for so long, those people would still be there. It makes no sense to me that the fact that they aren't working there anymore is even relevant - otherwise all companies would just tie up the proceedings for years.... And if the people who are left there want out - they just have to apply to decertify. They haven't. (And Walmart's not dumb - they've given them the paperwork)

Mathematically, it doesn't make sense for the union to do anything that would result in a store closure - dues over a longer period of time are worth a lot more than dues just until a store closes. And your example of the wholesale club wages just proves that unions work with the companies - otherwise they would be paid better at that store.

I don't think unions are evil, and my thought is if the people want them, they're allowed to have them. How do we know what it's like to work there?

I agree. WalMart steals time. I always had to keep a count of my hours in store after my paycheques were shorted a couple of times. They would feign ignorance if you brought it to their attention. The management team at WalMart when I worked there was a joke. They don't care about workers. They just want their quotas met and to pay you as little as possible. I'm not surprised that the union was able to get this far.

WalMart Union

To make this short, any WalMart that goes union means the employees would no longer receive WalMart benefits, only what the Union provides, and they have to pay dues, and still not get any further ahead. They would be exchanging one situation for another. Estevan saskatchewan isn't all that far from Weyburn, and closing the Weyburn store would not be a problem for the Company. Unions really do not look after their members any better than the Company does.

Perhaps it is you who is "misinformed". The employees at the Weyburn Walmart maybe did not "vote" for a union but they signed union cards which is pretty much the same. It means they made the choice for a union. You can call it what you want but the choice was still made. The people who left Walmart afterwards didn't leave because it took so long for the court proceeding to run its course, they left because other sectors in the local economy took off and were paying higher wages. Other workers then came in to fill their positions because they chose not to work in these other sectors. There are people who work at the Walmart store from the day it opened. They did not want a union 4 years ago and they sure as heck DO NOT want one now. I live here and I know them. And as far as the decertification is concerned, The employees should be asked now if they want a union. I bet you that they would not get any where near the numbers needed to certify the union at the store. There is no way that the union should be allowed to use the numbers from 4 years ago in order to certify the present day Walmart employees. How do you know they have been given the paperwork, are you familiar with what is happening out at the store. Probably not unless you live here. For all of you who wrote in here that Walmart sucks. You yourselves probably had a bad experience working there and that is why you hate Walmart. Get a job in the oilpatch where you're working on a drilling rig floor at 3 AM when it's 30 below zero and the winds blowing at 30 kph, that sucks but the money doesn't. I'll be back in a few days to read any further comments. This was my 2 cents but more change is coming.

Unionize Walmart, how stupid?

Sure then next when the next recessesion hits instead of bailing out out a bunch of overpaid autoworkers we can also bailout a bunch of overpaid Walmart workers ! Unions are mismanaged waste and Walmart SHOULD close the doors on the Weyburn Walmart store, and yes I'm from Weyburn and think this is totally embarassing for Weyburn not a victory! If I was a major franchise or retailer I wouldn't even consider opening anything up in this city after seeing this announcement. Most people probably do not know there is ample job opportunities within and around the city of Weyburn that have VERY competitive salaries or they just simply do not find people to work for them. I also understand that pretty much all the staff that was working at Weyburn Walmart when this was voted in have now left so for those of you working at Weyburn Walmart who do not agree or care about having a union please let it be known and if you feel you are not making enough money there are a lot of other choices around here.
Weyburn is finally a prosperous city with growth, why put an end to it ?

TIME FOR UNIONS HAS LONG SINCE PAST!

The time for unions has long since past. 2 of my daughters have worked in walmart from high school through university.

They are well paid and well treated. I consider Walmart a model employer.

I would expect this store to close based on this decision. Sadly the union organizers will then walk away, still wtih jobs and food on the table to feed their families - and they will forget about the employees that will lose their jobs- and the families and the town that will be inconvenienced.

Just say no to unions.

Why mess with a good thing!

I have been working for Wal-mart for over 2 years and can honestly say that it is the best job I have ever had. That includes the job of serving in the Canadinad Military. Fact is Wal-Mart, for me has been awesome. Have met lots of wonderful people. Work for tremendous management staff.

Wal-Mart was very up front with me in every way, from what my hours would be to pay and benefits. Why ruin a good thing and relationship and invite a union. Not for me that is for sure.

This is Canada, every person has the right to quit a job they don't like or can afford to stay at.If uions drives up the wages,to say safeway level then most customers will walk away to the the next discount store because the Walmart prices will not be competitive any more and they will leave town. You can be sure that they will not stay open if there is no profit.

In case you wonder about me I'm 59 years old and have never belonged to a union except for about 6 months in the late 80's and they never did anything for me.Each person has the freedom to choose their course and no other person can stop that. the beauty of Canada.

Read about the Wal-Mart Effect. This is what happens when a Wal-Mart moves into your area. Sure you get cheaper "stuff". But you also have lower wages.

Union Vote

If the union vote was a majority "yes", and those voting yes Knew of the likelihood of having the corporate office, well, shame on the union.

However. When a corporation has its managers keep employees working to clean the store for the next shift and the workers are working "off the clock", essentially for free, and anyone who complains is fired, well, that's where the desire to join a union comes in. Just one of many reasons-getting paid for hours worked.

Weyburn depends on this

Weyburn depends on this Wal-Mart. I do not agree that the union needed to try to infiltrate Weyburn's Wal-Mart. Sure it may seem like a small deal to some people, but Wal-Mart brings many commodities to Weyburn that were not there before, or have now been driven away by Wal-Mart's being there. If Wal-Mart were to close down, Weyburn residents would then need to drive 100 kms to either Estevan or Regina to get these commodities. The union should have gone somewhere else with their business, like a larger city with two or three Wal-Mart stores, that could possibly afford to lose one. Weyburn cannot afford to have a large empty grey building where Wal-Mart once stood.

People need stand up for what is right vs being threatened.

If Walmart closes it is because Walmart did it, not the union. The Walton family (children of Sam) still own 40% of WM. Each family member is sitting on tens of Billions in wealth.
Like it or not.....Canadians have the freedom and right to colective bargaining. Walmart disrepects Canada and Canadian law.
When are you people going to get any guts and stand up for your friends, family and neighbours who are being taken advantage of by this American retailer that is nothing more than a mass importer.
Why are you people so weak? Stand up for what is right. Walmart is not right...it is only a bully.
